WebDisk Send — Terms of Service

These terms (the "Send Terms") set out the conditions of the WebDisk Send service (the "Service") and supplement the general WebDisk SaaS Terms. Matters not covered here are governed by the SaaS Terms; in case of conflict, the Send Terms prevail.

Customer: the natural person or company that created an account in the Service (the "Customer" / "You" / "Sender"). A person downloading a file from a link (a "Recipient") needs no account and enters into no agreement with us — they use the Service solely to download the shared file.
1. Scope of the Service
1.1. WebDisk Send is a file-sending service: the Sender uploads a file, receives a download link and passes it to Recipients (directly or by e-mail through the Service). Files are stored temporarily — once the retention period of the Customer's plan elapses, they are automatically and irreversibly deleted (section 4).
1.2. The Service provides:
- a web panel for uploading files and managing transfers (a flat list of sent files),
- download links — optionally password-protected, with an expiry date and a download-count limit,
- e-mail delivery of links to designated Recipients, with a download counter,
- a public download page for Recipients (no account, no installs).
1.3. WebDisk Send is not a storage service. It is not intended for permanent storage, archiving or synchronization of files — that is what WebDisk Files (files.webdisk.io) is for. Files in Send exist only for the retention period of the plan.
1.4. Files are stored in S3-compatible object storage on WebDisk infrastructure in the European Union (section 6), in the Customer's logically separated space.
2. Account, registration, shared WebDisk account
2.1. Using the Service (including the free plan) requires an account. Registration takes place on the Service website and requires an e-mail address (which becomes the login), a password and acceptance of these Terms.
2.2. Sending files is possible after the e-mail address has been verified (by clicking the link in the verification e-mail).
2.3. The account is part of the shared WebDisk account — the same login and password may work in other WebDisk family services (e.g. WebDisk Files). Closing the Send account (section 8) ends the use of Send; it does not remove access to other WebDisk services the Customer actively uses.
2.4. The Customer is responsible for keeping the password confidential and for the proper use of MFA (TOTP) where enabled. If account compromise is suspected — change the password immediately and notify us by e-mail or via the "Report a problem" feature.
3. Plans and payments
3.1. The Service is available in two plans:
- FREE — free of charge, with limits set by WebDisk,
- PAID — a flat-price monthly subscription with higher limits.
3.2. Plan parameters (maximum single-file size, monthly transfer limit, file retention period) and the PAID plan price are set by WebDisk and visible at any time at send.webdisk.io/pricing and in the Customer panel. The values in force at the moment of registration or purchase are binding for the given billing period.
3.3. Payments are processed by Stripe (Stripe Payments Europe Ltd.). Prices are net; 23% VAT (or the applicable rate) is added to every payment. The subscription renews automatically every month until cancelled.
3.4. Cancelling the subscription. The Customer may cancel in the panel at any time — the PAID plan then remains in force until the end of the paid period, after which the account reverts to FREE. The cancellation may be undone before the period ends.
3.5. Failed payments. If a payment fails we send reminders; 14 days after the first failed payment the account reverts to the FREE plan.
3.6. Effect of reverting to FREE: the FREE plan limits (including the shorter retention period) apply from the moment of the plan change — files older than the FREE retention will be deleted in the next cleanup cycle (section 4). We recommend downloading any needed files before the PAID plan expires.
3.7. Changes to prices and limits. Changes in the Customer's favour (higher limits, lower price) may take effect without notice. Changes to the Customer's detriment (lower limits, higher price) are announced by e-mail with 30 days' notice; a price change applies from the next billing period.
4. Retention and automatic deletion
4.1. Every uploaded file has an expiry date = upload date + the retention period of the Customer's plan (the number of days is shown at /pricing and next to every file in the panel).
4.2. Once retention elapses, the file is automatically and irreversibly deleted by a daily cleanup process, together with its download links. We keep no copies of deleted files and they cannot be recovered.
4.3. The Customer may delete a file earlier at any time (panel button); deletion invalidates the associated links.
4.4. Deleting a file or its retention expiring does not reset the transfer counter consumed in a given month.
5. Transfers, links and responsibility for content
5.1. A transfer = one download of a shared file by a Recipient. The plan's monthly transfer limit covers downloads of all the Customer's files combined and resets on the first day of each calendar month. Once the limit is exhausted, downloads from the Customer's links are suspended until the next month begins (the Recipient sees an appropriate message); uploading and creating links remain possible.
5.2. Download links. Every link:
- may be password-protected (the Customer passes the password to the Recipient by their own means),
- may have an expiry date and its own download-count limit,
- may be revoked by the Customer at any time,
- expires at the latest when the file is deleted (retention).
5.3. The Customer's own downloads (from the panel) do not count as transfers.
5.4. Responsibility for content.
- The Customer bears full responsibility for the content they send and share through the Service,
- The Customer must not share content that violates the law or third-party rights (section 7),
- WebDisk does not proactively monitor transferred content, but may block a link or account violating these Terms upon a report or automatic detection (e.g. a malware signal).
5.5. Recipients. A link grants access to anyone who knows it (unless a password is set). The Customer alone decides whom to give the link to and bears the consequences of its further distribution.
6. Infrastructure and data location
6.1. Data location. All files and metadata are stored on WebDisk infrastructure located within the European Union (Poland). Data is not copied outside the EU/EEA.
6.2. Redundancy. The object store keeps multiple replicas of every object; the failure of a single disk or node causes no data loss. Redundancy does not change the nature of the Service, however — files are temporary and subject to retention (section 4).
6.3. Availability (SLA).
- Availability target for the panel and download links: 99.5% per month,
- Response time for standard support requests: < 24 business hours (09:00–17:00 CET, business days),
- If the SLA is exceeded, a PAID-plan Customer is entitled to a credit proportional to the downtime (max 50% of the monthly fee), claimed within 30 days of the incident.
6.4. Maintenance windows are announced by e-mail at least 72h in advance; critical security updates may require a shorter notice.
7. Acceptable Use Policy (AUP)
7.1. It is forbidden to use the Service for:
a) storing, sharing or processing child sexual abuse material (CSAM) — every case is reported to NASK / the Police without warning the Customer;
b) copyright and related-rights infringement — including distribution of illegally copied works, software, e-books, video content etc.;
c) distributing malware, ransomware, exploits or tools for unauthorized access;
d) phishing, fraud, spam, identity theft attempts — including mass-sending links to unknown recipients;
e) hate speech, terrorist content, incitement to violence;
f) doxxing — publishing third parties' personal data without a legal basis;
g) circumventing plan limits (e.g. automated creation of multiple free accounts).
7.2. Procedure on suspected violation.
- Upon detecting a violation (a report, automatic detection, an authority's demand) we may immediately block the specific link, file or the entire account,
- The Customer receives an e-mail describing the violation and a deadline to respond (usually 7 days),
- For violations under 7.1.a the block is immediate and without notice, and the case is referred to the authorities.
7.3. Authority demands. WebDisk complies with demands of authorities that are lawful under Polish law (Prosecutor's Office, Police, ABW, KAS, courts). We notify the Customer of a demand where the law permits us to do so.
8. Termination and the right to be forgotten
8.1. Account closure by the Customer. The Customer may close the account at any time with the "Close account" button in the profile (GDPR Art. 17). Closure is immediate and irreversible:
- all the Customer's files are deleted and links invalidated,
- an active subscription is cancelled (without a refund for the started period, unless consumer law provides otherwise),
- the account ceases to exist — using the Service again requires a new registration.
Unlike WebDisk Files, there is no grace period — files in Send are temporary by nature.
8.2. Data access (GDPR Art. 15 and 20). All the Customer's files can be downloaded from the panel at any time. A copy of the account data (profile, transfer list) is provided on request sent to support@webdisk.io or via "Report a problem", within 30 days.
8.3. Retention after account closure. After closure we keep:
- an anonymous access log (timestamp, action, status code — no personal data) — for 12 months, for security purposes,
- accounting metadata of transactions (amounts, payment identifiers) — for 5 years, as required by the Polish Accounting Act.
8.4. Termination by WebDisk. WebDisk may terminate the agreement:
- immediately upon a violation of section 7 (AUP),
- with 30 days' notice in other justified cases,
- with 90 days' notice if the entire Service is withdrawn from the market — with the ability to download files until the end of that period.
9. Subprocessors
WebDisk uses the following subprocessors to provide the Service:

Changes to the list are announced by e-mail with 30 days' notice. The Customer may raise a justified objection.
10. Reporting security incidents
10.1. Incidents on the Customer's side: the Customer promptly informs WebDisk of a security breach of their account (stolen password, suspicious logins, unintended sharing of a link to sensitive data) at support@webdisk.io or via the "Report a problem" feature in the panel.
10.2. Incidents on WebDisk's side: in the event of a data breach on our side we notify the supervisory authority (UODO) within 72h in accordance with GDPR Art. 33, and affected Customers without undue delay where high risk exists (GDPR Art. 34).
11. Final provisions
11.1. Changes to the Send Terms. These Terms may be updated. The version is always shown at the top of the document. Material changes are announced by e-mail with 30 days' notice and require renewed acceptance at the first login after they take effect.
11.2. Language precedence. In case of discrepancies between the PL and EN versions, the PL version prevails.
11.3. Jurisdiction. Disputes are subject to the jurisdiction of the Polish courts competent for WebDisk's seat; for consumers — as provided by generally applicable law.
